Welcome to Namekit. Please read these Terms of Service carefully.

1. Agreement to Terms

By accessing or using Namekit (“Service”), operated by Magic Monad LLC (“Company,” “we,” or “us”), you agree to be bound by these Terms of Service (“Terms”). If you disagree with any part of these Terms, you may not access the Service.

2. Description of Service

Namekit is a domain name search service that helps users identify available domain names. The Service includes both free and paid capabilities.

3. Accounts

When you create an account with us, you must provide accurate, complete, and current information. You are responsible for safeguarding your account credentials and for any activities under your account.

4. Subscriptions and Payments

4.1 Subscription Options

The Service offers the following payment options:

  • Free tier with limited capabilities (best-effort service)
  • Premium subscriptions with unlimited usage (subject to fair use policy, valid for the duration the Service operates)

For lifetime subscriptions, “lifetime” means for as long as the Service continues to be offered by the Company. If the Service is discontinued or the Company ceases operations, lifetime subscriptions will terminate without refund.

4.2 No Refund Policy

All payments are non-refundable. We do not provide refunds for any subscription fees paid.

4.3 Subscription Changes

We reserve the right to modify, suspend, or discontinue any aspect of the subscription options at our discretion.

5. Service Limitations

5.1 Usage Limitations

Free Tier Limitations

The free tier is provided on a best-effort basis with rate limits on usage. We make no guarantees regarding availability or performance for free tier users.

Premium Tier Fair Use Policy

Premium tiers offer unlimited usage subject to our fair use policy. “Fair use” means using the Service in a manner that is reasonable and not excessive as determined by us. Examples of unfair use include but are not limited to:

  • Automated scraping or bulk querying that exceeds normal individual usage patterns
  • Sharing account access with multiple users beyond the authorized account holder
  • Using the Service in a way that negatively impacts other users’ experience

We reserve the right to limit or suspend service to premium users who violate this fair use policy.

5.2 Service Availability

We strive to provide uninterrupted service but do not guarantee 100% availability. We assume no liability for temporary service interruptions, downtime, or technical issues.

6. User Conduct

You agree not to:

  • Use the Service in any way that violates applicable laws
  • Circumvent or attempt to circumvent rate limits or other usage restrictions
  • Engage in any activity that interferes with or disrupts the Service
  • Attempt to access any parts of the Service that you are not authorized to access
  • Use the Service in any way that engages in any illegal activities

7. Intellectual Property

7.1 Our Intellectual Property

All content, features, and functionality of the Service are owned by the Company and are protected by copyright, trademark, and other intellectual property laws.

7.2 Domain Names

We make no intellectual property claims regarding domain names discovered through our Service. The registration, ownership, and use of any domain names you discover through our Service are entirely your responsibility.

8. Third-Party Services

The Service may integrate with or rely on third-party services. Your use of these third-party services may be subject to additional terms and conditions provided by those third parties.

9. Termination

We reserve the right to suspend or terminate your access to the Service at our sole discretion, without notice, for any reason, including but not limited to a breach of these Terms.

9.1 Account Inactivity

We reserve the right to terminate accounts that remain inactive for a period of twelve (12) consecutive months. For free tier users, inactive accounts may be terminated without notice. For premium users, we will provide email notification at least 30 days prior to termination due to inactivity.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE COMPANY BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL DAMAGES, OR ANY DAMAGES WHATSOEVER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF USE, DATA, OR PROFITS, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OR PERFORMANCE OF THE SERVICE.

11.1 Indemnification

You agree to indemnify, defend, and hold harmless the Company, its affiliates, officers, directors, employees, consultants, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) that arise from or relate to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of any other person or entity; or (d) your violation of any applicable laws, rules, or regulations.

12. Data Collection and Privacy

We collect and process personal data as necessary to provide the Service. This includes basic authentication information such as name, email, and access tokens. For more details, please refer to our Privacy Policy.

12.1 Data Retention

Following termination or deactivation of your account, we may retain your information for a commercially reasonable time for backup, archival, or audit purposes. Any continued use of information after account termination will be in accordance with our Privacy Policy.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by updating the “Last Updated” date at the top of these Terms. Your continued use of the Service after such modifications constitutes your acceptance of the modified Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.

14.1 Dispute Resolution

Any dispute arising from or relating to these Terms or the Service shall be resolved exclusively through binding arbitration in Delaware under the rules of the American Arbitration Association. The arbitration shall be conducted by a single arbitrator, and judgment on the award may be entered in any court of competent jurisdiction. You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

14.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect and enforceable.

14.3 Assignment

These Terms are personal to you, and you may not assign, transfer, or sublicense your rights or obligations under these Terms to anyone else. The Company may assign, transfer, or delegate any of its rights and obligations under these Terms without your consent.

14.4 Export Compliance

The Service may be subject to export laws and regulations. You represent and warrant that you are not located in a country that is subject to U.S. Government embargo, or that has been designated as a “terrorist supporting” country, and you are not listed on any U.S. Government list of prohibited or restricted parties. You shall comply with all applicable laws regarding the transmission of technical data exported from the United States or the country in which you reside.

16. Complete Agreement

These Terms constitute the entire agreement between you and the Company regarding the Service and supersede all prior and contemporaneous agreements, proposals, or representations, written or oral, concerning its subject matter.
